Marriage Contracts
Although Manitoba does not automatically recognize religious marriage contracts, HJ Law assists couples draft Nikah contracts that are both Islamically valid and legally enforceable. We ensure that the religious contract meets legal standards, ie: clear terms, mutual consent, and proper documentation.
Divorce & Separation:
Divorce in Manitoba is governed by the federal Divorce Act and provincial Family Law Act. Grounds for divorce include breakdown of marriage due to separation, adultery, or cruelty. HJ Law guides clients through both civil divorce and religious processes such as talaq, khula, and Iddah, ensuring that your divorce complies with both aspects.
Parenting Arrangements:
In the case of separation or divorce where kids are involved, we help families create parenting plans that reflect Islamic value such as maintaining ties with both parents and extended family.
Child & Spousal Support
Support is calculated using federal guidelines. Manitoba’s Family Support Enforcement Act allows enforcement through the Maintenance Enforcement Program (MEP). HJ Law will ensure that your support obligations align with both legal and Islamic principles of financial responsibility.
Property Division
Manitoba Law presumes equal division of marital property, including homes, pensions, and savings. Exceptions may apply based on agreements or contributions. We help Muslim clients navigate these challenges by considering Islamic inheritance principles and any civil agreements made during marriage.
Wills & Inheritance Planning
Canadian Law allows individuals to distribute their estate through wills, in accordance with certain legal limitations (eg. Spousal and dependent rights). Although, Islamic Inheritance rules are not automatically applied they can be reflected through proper estate planning which HJ Law helps its clients with.
Adoption & Guardianship
Manitoba Law permits adoption and guardianship through court approval. Guardians can be appointed for minors when parents are unable to care for them. We will provide guidance on adoption that respects views on lineage, caregiving, and inheritance.
Domestic Violence & Protection Orders
Manitoba courts offer protection orders under the Domestic Violence and Stalking Act. Victims can seem emergency or long-term orders to ensure safety. We work with community organizations to ensure holistic care.
